We reserve the right to update these terms at any time by posting a revised version on this page with an updated effective date.
Custom Morgan Hill Fence provides residential and commercial fence installation, repair, replacement, and related services in the greater Morgan Hill, California area. Services are subject to availability and geographic coverage. We reserve the right to decline any project at our discretion.
Information on our website is provided for general informational purposes only. It does not constitute a binding offer or guarantee of service, pricing, or availability.
All estimates provided by Custom Morgan Hill Fence are based on conditions observed at the time of the site visit and information provided by the customer. Estimates are not binding quotes unless confirmed in a written agreement signed by both parties.
Final pricing may change if site conditions differ materially from what was visible during the estimate, if the scope of work changes at the customer's request, or if unforeseen conditions arise during the project (such as encountering buried obstructions, unstable soil, or utilities not identified during the 811 call).
Any price change beyond the original written agreement will be discussed with you before additional work proceeds.
Work is scheduled based on crew availability, permit timelines, and material delivery. We will provide you with a projected start date, but this date may shift due to weather, permit delays, or other factors outside our control. We will notify you as soon as possible of any schedule changes.
If you need to cancel or postpone a scheduled project, please contact us at least 48 hours in advance. Cancellations with less than 48 hours notice may result in a fee to cover crew mobilization costs, as specified in your written agreement.
We reserve the right to reschedule work due to unsafe weather conditions, including high winds, rain that would affect concrete curing, or other conditions that could compromise the quality or safety of the installation.
Payment terms are outlined in the written project agreement provided before work begins. In most cases, a deposit is required to secure your project on the schedule, with the remaining balance due upon project completion.
Accepted payment methods will be specified in your agreement. Invoices not paid within the stated timeframe may be subject to a late fee as described in the agreement.
Work will not commence without a signed agreement and any required deposit. Final walkthrough and sign-off by the customer is required before the project is considered complete.
You are responsible for providing accurate information about your property, including property lines, HOA requirements, and the location of irrigation lines or other underground utilities not covered by the 811 dig-safe service.
If a fence is installed in the wrong location due to incorrect information you provided, the cost of correcting the work will be your responsibility. We strongly recommend confirming your property lines before work begins, especially near neighboring properties.
Where required by the City of Morgan Hill or other governing authorities, we will apply for the necessary building permits as part of your project. Permit fees are typically included in your written estimate. Work will not begin until required permits are issued.
You are responsible for obtaining any HOA approvals required before work begins. We can provide documentation or design specifications to assist with your HOA submission, but the submission and approval process is your responsibility.
Any warranty on materials or workmanship will be described specifically in your written project agreement. Warranties are void if the fence or related structures are modified, misused, or damaged by circumstances outside our control, including but not limited to vehicle impact, vandalism, extreme weather events, or soil movement beyond normal seasonal variation.
Our website and any information on it are provided "as is" without warranty of any kind. We do not warrant that the site will be error-free or uninterrupted.
To the fullest extent permitted by law, Custom Morgan Hill Fence shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services or website, including loss of profits, loss of data, or property damage beyond the direct cost of the work performed.
Our total liability for any claim related to a project will not exceed the amount paid by you for that specific project.

If direct resolution is not possible, disputes will be resolved through binding arbitration in Santa Clara County, California, in accordance with the rules of a mutually agreed-upon arbitration provider, unless applicable law requires otherwise. You waive any right to bring claims as a class action or consolidated proceeding.
These Terms and Conditions are governed by the laws of the State of California, without regard to its conflict-of-law provisions. Any legal action that is not subject to arbitration under Section 10 shall be brought exclusively in the state or federal courts located in Santa Clara County, California.
